Legal Notice

The Democratic Party in the Town of Pine Plains will hold a caucus on Friday, September 7, 2018 at 7:00 p.m. at the Community Room above the Pine Plains Free Library, 7775 S. Main Street. The purpose of the caucus is to nominate a candidate for the office of Town Justice.

The caucus will be followed by refreshments and a discussion of plans for turning out voters for the mid-term elections on November 6.

The caucus is open to all residents of the Town of Pine Plains who are registered as Democrats.

 NOTICE is hereby given that sealed bids for the purchase of supplies used by the Amenia Highway Department during the year will be received until 10 a.m. on Wednesday, September 12, 2018 at the Town Clerk’s Office, Town of Amenia, Town Hall, 4988 Route 22, Amenia, NY 12501 and opened and read at the Amenia Town Hall, 4988 Route 22, on Wednesday, September 12, 2018 at 10:30 a.m.

Bids are requested for the following road materials: Bank-run, sand, Item #4, crushed quarry stone and washed gravel, light, medium, and heavy stone fill, sub base NYS DOT Type #2, calcium chloride, bituminous mix hot and cold, road oils, concrete, catch basins and equipment rentals, Tree Work, Sweeping.

Detailed specifications may be obtained at the Highway office at 845-373-9922. All bids must include a notarized non-collusive statement and corporate bidders must file a corporate resolution with a corporate seal. All envelopes must be clearly marked “Bid 9/20/2018 to 9/19/2019”

The Town Board reserves the right to accept or reject any or all bids. Bids will be awarded at the next scheduled Town Board Meeting September 20, 2018.

Town of Amenia Zoning Board of Appeals

Notice of Public Hearing

Appeal of Kent Hollow, Inc.

PLEASE TAKE NOTICE that the Zoning Board of Appeals (ZBA) will hold a public hearing on Monday, September 17, 2018 at 7:00 o’clock at the Town Hall, 4988 Route 22, Amenia, New York p.m., to hear the appeal of Kent Hollow Inc. from a Notice of Violation (NOV) issued by the Town Code Enforcement Officer (CEO ) on May 1, 2017.

Kent Hollow owns property at 341 South Amenia Road, also identified as Parcel #132000-7165-00-863977 on the Tax Map of the Town, located in the R-A Zoning District.

The NOV states that Kent Hollows application for a DEC permit to allow mining of sand and gravel on 34 acres of its property violates the Towns Zoning Code, in that the property to be mined is not located within the SMO Zoning District and the owner does not have the required special permit. It also states that the CEO determined in 2012 that mining was prohibited on the Kent Hollow property.

Preexisting nonconforming soil mining operations are governed by ß 121-27D(3): a nonconforming soil mining operation may expand by mining within the boundaries of the original parcel on which the mine was legally permitted, but only to the extent allowed by an existing DEC permit or as otherwise provided by the laws of New York State.

 Kent Hollow appeals to the ZBA on the following grounds: its use of its property as a mine is a pre-existing, non-conforming use that pre-dates the current Zoning Code and the 2007 SMO amendments: that use has been continuous since then; and it has a vested right to expand its mining operations to its entire property, including the 34 acres proposed in its application for a new DEC mining permit, without the special permit otherwise required by the Town Code, and other related arguments.

In support of its appeal, it offers supporting documents to show that it acquired the property for mining purposes, conducted mining activities on the property prior to the Towns 1973 zoning law, that Town officials acknowledged the non-conforming use existing on its property in connection with DEC permit applications between 1975 and 1989, that it held DEC permits to mine materials from the property between 1976 and 1989, that it thereafter excavated materials under the DEC permit threshold continuously to 2007, and that it has continued such activity to the date of the NOV.

Section 121-59 A.1 of the Town Code authorizes the ZBA to reverse or affirm, wholly or partly, or modify the order appealed from, and make such order or determination as in its opinion ought to have been made by the code enforcement official. In so doing, it has the powers of the administrative official from whose order the appeal is taken.

On this appeal, the task of the Board is to consider whether the appellant has established that the determination of the CEO was made in error, not whether mining activities should be permitted on this property. The purpose of the public hearing is to allow the appellant to present its case, and to provide interested members of the public with an opportunity to be heard on the merits of the appeal.

Therefore, the ZBA encourages comment relevant to the issues raised on this appeal, including the nature and scope of activities on the property prior to the 1973 zoning law; whether the activities constituted mining within the meaning of the Towns zoning law; whether the property was continuously used for such purposes between 1973 and 2017; whether the owner had established a nonconforming use at the time of the 2007 zoning amendments and has continued that nonconforming use since; and whether the owner manifested its intent to utilize the entire property for mining activities prior to adoption of the Towns1973 Zoning Law and the 2007 amendments.

TAKE FURTHER NOTICE, that the appeal and supporting documents will be available for review at the Town Hall during normal business hours between the date of this notice and the date of the public hearing. The appeal and supporting documents will also be available on the Towns website at www.ameniany.gov.

TAKE FURTHER NOTICE, that all interested persons have an opportunity to be heard on said appeal at the time and place aforesaid. In view of the complex issues, the time constraints of a public hearing, and the Boards desire to ensure that comments can be considered fully and fairly by the Board, the Board encourages the submission of written comments. The hearing may be closed on that date or adjourned to another date, as the Board deems appropriate.

I, Joan C. Taylor, School Tax Collector, have received the Tax Warrant for the collection of school taxes for the Pine Plains Central School District. Taxes can be paid at the Stissing Mountain JuniorSenior High School, 2829 Church Street, Pine Plains, NY 12567. The days and hours of collection are Monday, Tuesday, Thursday, Friday 3:00PM to 5:00PM, Wednesday from 5:00PM to 7PM, except holidays. A drop box will be available in the lobby of the Jr. Sr. High School between the hours of 8AM and 5PM Monday through Friday (except school holidays).

Collection of taxes will begin on September 5, 2018 and will end November 5, 2018. School taxes paid and or postmarked during the first 30-day period, September 5, 2018 to and including October 4, 2018 will be penalty free. School taxes paid October 5, 2018 to and including November 5, 2018 must include the two percent (2%) penalty or the payment will be returned.

Please be advised that the Board of Education of the Pine Plains Central School District has adopted a Tax Installment Payment Option for Dutchess County Property Taxpayers only. Taxpayers may pay school taxes in two (2) installments pursuant to Dutchess County Local Law no. 4 of 1978. The first school tax installment of 50% of the tax due together with a five per cent (5%) fee is due on September 15, 2018 payable to the Pine Plains School Tax Collector and the second installment of 50% of the tax due, together with a five percent (5%) fee, is due no later than March 15, 2019 made payable and mailed directly to the Dutchess County Commissioner of Finance.

Also, please be advised that there is a five business day penalty-free extension date for the payment of school taxes for property owners who have a Senior Citizen’s Exemption under Real Property Tax Law Section 467. The last penalty-free date for payment of school taxes for those property owners who have a senior citizen’s exemption is October 12, 2018.

The collection period with the two per cent (2%) penalty will conclude on November 5, 2018 and all unpaid tax records will be returned to the County Treasurer. After that date, payment of school taxes can be made by contacting the County Commissioner of Finance.
