NOTICE TO BIDDERS

NOTICE IS HEREBY GIVEN that the Town Board invites sealed proposals for the furnishing of all materials and labor necessary for the construction of the Mill Road Culvert Replacement, in North East, New York. This Contract has been designated as set forth in these contract documents, including drawings and specifications, prepared by Morris Associates Engineering & Surveying Consultants, PLLC, 64 Green Street, Hudson, NY  12534.

All such sealed proposals must be received by the Town of North East Town Clerk at 19 North Maple Avenue, Millerton, New York 12546, on or before 2:00 p.m., May 22nd, 2018, at which time the bids will be publicly opened and read aloud.  Mailed Bids should be sent to Town of North East Town Hall, P.O. Box 516, Millerton, New York 12546 and must be received by 2:00 p.m.

Copies of the proposed contract documents, including plans and specifications, and the forms of proposals for the contract, are available for public inspection and purchase at Town of North East Town Hall, 19 North Maple Avenue, Millerton, New York 12546 during business hours, Monday to Thursday 9:00AM-12:30PM and 1:00PM- 4:00PM, Friday 9:00AM-12:30PM and becoming available April 26th, 2018.  Pursuant to the provisions of GML 102, persons desiring to take a copy may obtain them, subject to a deposit in the amount of $50.00 for each set, payable by check or money order, to guarantee their safe return, such deposits to be refunded or partially refunded under the provisions of GML 102. Such documents are also available for examination at the office of Morris Associates and the Town of North East Town Hall during business hours.

All proposals shall be made and received upon the following conditions, which are more fully set forth in the bid documents:

1. Only such proposals as are made and filed upon the forms available in the office of the Town Board of the Town of North East will be accepted.

2. Proposals are to be enclosed in a sealed envelope so marked “Town of North East Mill Road Culvert Replacement”.

3. Each proposal must be accompanied by a certified check in the sum of five percent (5%) of the amount bid, payable to the order of the Town of North East, or a bond with sufficient sureties, to be approved by the Town Board of the Town of North East, in such amount, conditioned that if the proposal is accepted, the bidder will enter into a contract for the same and will provide acceptable security, in the form of cash, certified check or performance bonds, or letters of credit, as set forth in the contract documents, for the faithful performance of the contract, within 15 days from the acceptance of the proposal.

4. Pursuant to the provisions of GML 105, no bids may be withdrawn unless no contract is awarded for more than 45 days after the opening thereof.  Upon such proper withdrawal of bid, the deposit shall be forthwith returned.  After award of the contract, all bid deposits or other bid bonds except that of the successful bidder will be returned.

5. Upon acceptance of the bid, if the successful bidder fails to enter into a contract pursuant to the requirements of said Town Board or fails to give further security prescribed in this notice within the time noted herein, then the check deposited as aforesaid, and the moneys standing to the credit of the same shall be forfeited to the Board as liquidated damages and not as a penalty and the Town Board shall collect the same or enforce the payment of the bond for the benefit of the Town Board.

6. All bids shall contain the non-collusion certificate in a form meeting the requirements of GML 103-d. 

The Town Board of North East reserves the right, in its discretion, to waive technical noncompliance or irregularities that are not material or substantial, and to reject all bids and to rebid the project.

TOWN OF AMENIA

REQUEST FOR PROPOSALS (RFP)

Notice is given that the Town of Amenia hereby requests proposals from interested persons for the following:

“Operation of a Food Concession Stand at Beekman Park in the Town of Amenia from May 4, 2018 through November 4,2018”

Background Information: Beekman Park is located on State Route 44 in the Town of Amenia, New York.  Weather permitting, the Licensee shall be permitted to operate the concession stand every day, from May 4, 2018 through November 4, 2018 on which a baseball or softball game or other recreational activity is scheduled by the Town of Amenia Recreation Commission, from one (1) hour before the scheduled starting time of every such game to one (1) hour after every such game ends.  The successful applicant will be required to enter into a License Agreement with the Town of Amenia, which shall include, but not be limited to, the following terms and conditions:

1. The successful applicant may sell only food and non-alcoholic beverages at the concession stand, and only at reasonable competitive prices.

2. Beekman Park is a totally smoke-free area.

3 The successful applicant shall secure and keep general liability insurance, as well as workers’ compensation and disability benefit insurance in amounts required by New York State law.  A certificate of insurance shall be required prior to execution of the License Agreement.

4. Necessary equipment other than that provided by the Town of Amenia shall be provided by the successful applicant and insured by the successful applicant, if coverage is desired.  The licensee shall use reasonable and diligent care in using and maintaining the Concession Stand and equipment in a condition as good as at present, ordinary wear and usage expected.  At the time that the license agreement is executed, the successful applicant shall also be required to post a security deposit with the Clerk of the Town of Amenia in an amount acceptable to the Town Board.  If the Concession Stand and equipment is returned in a condition as good as at present, ordinary wear and usage accepted, said deposit shall be returned to the successful applicant.

5. The Town of Amenia reserves the right to terminate or revoke the license agreement at any time and for any reason, subject to the successful applicant’s right to recover a pro-rated portion of the License Fee in the event of a termination or revocation without cause.

Submission Requirements: Sealed proposals must be marked “Operation of a Food Concession Stand at Beekman Park ball field in the Town of Amenia from May 4, 2018 through November 4, 2018” and must be delivered in duplicate in writing to the Town Clerk, Town of Amenia Town Hall, 4988 Route 22, Amenia, New York 12501, no later than 12:00 p.m. on May 3, 2018.  All proposals must include a copy of a “Non-Collusion Certificate,” signed by the person or the head of the organization submitting the proposal.

Selection: Proposals will be publicly opened and read in the Town Hall, 4988 Route 22, Amenia, New York, at 7:00 p.m. on May 3, 2018, and thereafter be considered by the Town Board.

THE TOWN BOARD RESERVES THE RIGHT TO REJECT ALL PROPOSALS, OR ANY PART THEREOF, TO CONSIDER THE REPUTATION OF THE APPLICANT IN MAKING ITS SELECTION, TO WAIVE ANY INFORMALITIES OR MINOR DEVIATIONS HEREFROM, AND TO SELECT OTHER THAN THE HIGHEST APPLICANT IF THE SELECTED PROPOSAL IS DEEMED TO BE IN THE BEST INTERESTS OF THE TOWN OF AMENIA.

A. To elect two (2) members to the Board of Education, for three-year terms, commencing July 1, 2018 and expiring on June 30, 2021.   

B. PROPOSTION I:  2018-2019 Webutuck School BudgetShall the 2018-2019 Budget in the amount of $22,703,351adopted by the Board of Education with anticipated revenue exclusive of taxes in the amount of $8,809,779 and the amount to be raised through taxes of $13,893,572 be approved?

C. PROPOSTION II: 2018-2019 Transportation Vehicle Purchase 

Shall the Board of Education of the Webutuck Central School District be authorized to: (1) acquire ONE (1) school bus and THREE (3) minivans at a maximum aggregate cost of not to exceed $147,000; (2) expend such sum for such purpose; (3) levy the necessary tax therefore, to be levied and collected in annual installments in such years and in such amounts as may be determined by the Board of Education taking into account state aid; and (4) in anticipation of the collection of such tax, issue bonds and notes of the District and/or enter into installment purchase agreements at one time or from time to time in the principal amount not to exceed $147,000, and levy a tax to pay the interest on said obligations when due?

D.  To vote on any other proposition legally proposed.

AND FURTHER NOTICE IS HEREBY GIVEN that the qualified voters of the School District shall be entitled to vote in said annual vote and election.  A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen (18) years of age or older, and (3) resident within the School District for a period of thirty (30) days preceding the annual vote and election.  The School District may require all persons offering to vote at the budget vote and election to provide one form of proof of residency pursuant to Education Law section 2018-c.  Such form may include a driver’s license, a non-driver identification card, a utility bill, or a voter registration card.  Upon offer of proof of residency, the School District may also require all persons offering to vote to provide their signature, printed name and address.
