The ZBA is in need of a volunteer

NORTH EAST — Have an interest in zoning, or perhaps a penchant for special permitted uses? If so, you could be exactly what the town’s Zoning Board of Appeals (ZBA) is looking for. The board is seeking a volunteer to fill  the seat vacated by Diana Paine, who left the ZBA in April due to time constraints. There are three years left of the five-year term.

“We need one member right now,� ZBA Chair Julie Schroeder said. “And it would be nice to get somebody who took a real interest in it.�

What Schroeder is really hoping for, she said, is to find someone interested enough to be groomed for the chairman position, someone who has the time and the ability to undertake the challenges that go along with it. She was quick to point out that she has no desire to leave the board she’s been on for more than two decades — she just wants to step down from the chairman’s seat.

“It’s like being chairman of any board. You’ve got to anticipate questions and make sure these applications are complete and that the board has as much information as possible before starting the hearing process,� she said. “And any chair is key in getting people to compromise, to come together and reach fair and just decisions. He or she must have some knowledge, some understanding, of zoning. There’s a lot of case law — that’s what makes it very interesting.�

The Zoning Board of Appeals is unique in that it actually gets its authority from the state, not the Town Board. As with other boards, it’s not supposed to be political; it’s meant to be objective.

“I think that scares a lot of people, but we’ve never been pressured in any way, from public hearings or articles in the press, about something that’s controversial,� Schroeder said. “We just have to follow the law and we can’t act beyond our authority.�

“It’s a deliberative body that has to weigh appeals in the public when it comes to zoning matters,� added town Supervisor Dave Sherman.

Usually there is a monthly meeting as well as educational programs that occur throughout the year within Dutchess County. Matters that arise before the ZBA include set-back issues, variance requests, special permit requests, etc.

“The Town Board is responsible for writing the zoning legislation, but then it has to be administered and the ZBA is partially responsible for that — not enforcing, but administering,� Schroeder said. “We have to review each case individually, but I feel the ZBA over the years has been instrumental in maintaining the area. We’ve had good economic development and we’ve maintained good property values, and I think that’s key for everyone.�

Anyone interested in applying for the position should submit a letter of intent or a resume to the town supervisor or the town clerk at Town Hall, at 19 North Maple Ave., Millerton, NY 12546.

The nuisance of needless noise from automobiles is sharply dealt with in Document 15 of the Motor Vehicle Department, especially the practice of tooting at intersections to signify plan to hold speed and grab right of way, instead of slowing down and using eyes.
